The government has no business interfering in an individual's sexual orientation.Banning two adults from consensual sex indicates oppresiveness in the legal system.

The issue that homosexuality to be decriminalized or not essentially needs a discussion of the basic understanding of homosexual behavior.
To put it this way, homosexuality and homosexual act are NOT same. There are plenty of people (of course no valid statistics in India) who do engage in some kind of same sex ACTs during their life time…..The reasons are: 1) Just being curious about the VERY word SEX during adolescence, 2) Being curious about the so called unexplored pleasure during the formative years, 3) Some times this could be due to compulsion like by some homosexual seniors/in some places like hostel/jail/army camp 4) Just to get some sexual pleasure EASILY from gay men as they are AVAILABLE and there is no social responsibility(!!!!!!- told to me by one bachelor man explaining his male to male sex behaviour)…etc etc.
BUT this can never be equated with being HOMOSEXUAL. I tell you why> >. People who may engage themselves in such same sex acts in some part of life, may start leading a SO CALLED "NORMAL" heterosexual life later on if the factor (mentioned earlier) is removed. But a homosexual man/woman is ALWAYS living in the paradigm of same sex LOVE and same sex PHYSICAL INTIMACY. Even if they TRY HARD to live a SO CALLED "NORMAL" heterosexual life they can NEVER restrict them being drawn towards their same sex partners. In this regard I would differ from a common belief that homosexuality is a choice. In fact, given a choice, I feel these people would never want to be such, as life for them is miserable. (The scientific studies have proved the gene responsible for gay behaviour-Y29….and studies have also shown that the brain of gay men is relatively bigger than heterosexual men)

I sited these reasoning to facilitate the idea and science behind the understanding.

In India, NACO estimates, 2.5 million gay men, who I believe is, just TIP OF THE ICEBERG (Remember- we can see the 1/11th of the iceberg!!!- Simple physics)

The decriminalization will of course help respecting one's individuality but there are bigger issues that need to be addressed.

Ever since the debate of removal of Section 377 has started, there is always a news and concern that, it would help preventing spread of AIDS. I completely agree…but sometimes it seems it is only the gay men who are responsible for spreading AIDS (!!!!). In fact, it is the multiple partner sex by heterosexuals which contributes the majority of AIDS burden across the world, as per WHO or UNICEF statistics.

I feel if Section 377, if at all to be removed and homosexuality to be legalized it should be done to recognize an individual as his/her own self. I would like to site one incident…The other day, there was an ad of a new movie to be released. And one of my doctor colleagues told me: "Ar-e this is that CHAKKA'S movie NA?" I was surprised listening to such a derogatory and insulting remarks on a film director>>>> Why one's entire creativity and contribution is disrespected because he/she belongs to a certain sexual orientation.

There is a common perception that gay men are effeminate which is absolutely bogus. We always oversimplify and generalize things. In fact there are effeminate guy who are straight and hunks who are gay.

Thus I would suggest:
Educate doctors first
Make sex education compulsory at school level.
Introduce elementary psychology at school level
Consider removal or inclusion of any law NOT only for preventing AIDS or such but to give these people respect in society.
India is the largest democracy and thus I feel demand of so many homosexuals should be heard. ( Remember: Heterodoxy is a tradition in India and that should be followed.)

Remember even if we don't want to see or address the issue that does NOT mean that homosexuality is not there. And for god's sake, I hope those overtly Nationalist champions will stop telling that homosexuality is imported from west.

As a Indian citizen, as a human being I would expect every single individual in this country would live with his/her dignity and respect.

Good write up sir, I am all for the law being equitable for all the citizenry of the nation. Peaple who have alternate sexual preferences are normal and should never be discriminated against. Sec 377 is archaic and should be scrapped.

It is not law that stigmatizes such people. In fact society considers such men as not normal in their sexual behavior. With all these well argued position it seems the same sex, apart from occasional encounters, is a psychological problem rooted in gene. If treatment in medical sciences is possible that is what is needed. If law has become irrelevant in the context of new evidence it calls for a change. My only apprehension is that society will have to deal with this phenomenon once it is legitimized as separate source of social affliction like prostitution, which has been in existence for centuries. Not that homosexuality has been a new phenomenon, but that it is now being discussed in public more

Bravo !! Another dude with brains and logic !! Why don't I see more of your kind man? It's always refreshing to see people who can weigh an argument without basing it on some irrelevant logic like GAYS SPREAD AIDS. What most of these dudes don't know is that it's the ignorant nature of Indian straight men that contributes to the spread of the disease! Arguments like "Family planning is against the will of our god", "Family planning is against Islamic principles" and blah blah balh is what's becoming the major source of our problems. Straight men wouldn't use condoms as they're being told by their religious leaders that it's god's will to procreate and hence they end up increasing not just out population but also chances to contract HIV because of the promiscuous nature of men in general.
