Earlier, when the petition for protection was taken up by the First Bench, comprising Chief Justice M Y Eqbal and Justice K B K Vasuki, Gopal's counsel advocate P T Perumal informed the court that water and electricity supply to the magazine's office had been cut. Disapproving of the action, the Court remarked 'you are the government and you are for all, irrespective of caste, colour and party affiliation. When a junior advocate for Metrowater sought time to get instructions, Justice Eqbal said the matter was sensitive and appeared daily in newspapers. State Advocate General A Navaneethakrishnan claimed it was disconnected as there was a specific complaint of pollution. Justice Eqbal, however, asked why the action was taken all of a sudden.
