HC asks BMC to submit hawkers scheme in Bandra fair on Aug 29

Mumbai, Aug 23 (PTI) Asking the Brihanmumbai Municipal Corporation (BMC) to show some preference towards the poor and destitute during fairs and festivals, the Bombay High Court today directed the civic body to place before it the scheme formulated to manage hawkers during the Mount Mary Fair in suburban Bandra. A division bench of Justices P B Majmudar and R M Sawant were hearing an application filed by few local residents challenging the Corporation's decision to auction the 170 stalls that would be put up during the September fair. "Several local residents, who are from the lower strata of the society put up stalls selling candles during the fair and earn their livelihood, but now they cannot do so as the civic body has decided to auction the stalls," the application stated. The court was informed by the corporation that as per an earlier order passed by HC in September last year, the Deputy Municipal Commissioner had mooted a proposal for proper management of hawkers during the fair, which is still pending for sanction before the Municipal Commissioner. "The fair is to start on September 11 so all the more reason for the civic body to act expeditiously and submit the scheme on August 29 before us," the bench directed. It also asked the Corporation to show preference towards poor persons who have been earning their livelihood by selling candles during the fair. "For something like selling candles no rich person will try to make huge profits. In such fairs and festivals preference should be given to the poor. Out of 170 stalls, the civic body can earmark a few stalls for people from the lower strata of the society," Justice Majmudar said. BMC lawyer said the proposal sent by the Deputy Municipal Commissioner has recommended the same following which the court directed for the scheme to be submitted before the court on August 29.
