

HC lays down rules for filing PILs
PTI | 03:08 AM,Aug 28,2010Madurai,Aug27(PTI) To check the spate of Public interest litigations being filed, the Madras High Court Bench here today issued a judicial notification containing rules for filing PILs. The rules circulated to the Advocates said every PIL must indicate that the petitioner had no personal interest in the case.Even if he had any personal interest,the same must be disclosed.The PIL would be dismissed with exemplary cost if found frivolous and vexatious,the notification said. In case PIL was filed by a group or association or Society then the Petitioner must enclose the resolution from such society or assocation authorising him to file it.The bye-laws of the said body authorising the petitioner to file PIl must also be enclosed. The PIL would not be entertained in respect of civil disputes, between individuals and service matters. The petitioner should give an undertaking that he would pay the costs, if any, if it was found to be intended for personal or oblique motive. The petitioner must also state if PIL was filed out of own funds or from other sources,and particulars given.The petitioner must state that to his knowledge no PIL on the same issue had been filed. The PIL based on an information received from any other source, must clearly indicate the source,the notification said If it was a newspaper report,the affidavit should clearly state as to whether the deponent had verified the facts by personally visiting the place or talking to responsible person or reporter or editor.The petitioner should also file the copy of the representation to any authority before filing the PIL. The court said the rules would not be applicable to the PIL taken on file by the High court suo motu.
