HC notice to Gujarat govt on petn against regularisation act
PTI | 08:11 PM,Nov 28,2011Ahmedabad, Nov 28 (PTI) Gujarat High Court today issued notices to the state government and the Advocate General on a petition challenging the act which provides for regularisation of unauthorised constructions. Gujarat Regularisation of Unauthorised Development (GRUD) Act, 2011, which seeks to regularise several lakhs of unauthorised constructions by charging "impact fee", was passed for the second time during the state assembly's session in September, and approved by the Governor last month. Governor, Dr Kamla, had returned it to the assembly earlier, saying that some provisions of the bill were not appropriate, when it was passed for the first time. Raj Prajapati from Gandhinagar has filed a petition demanding GRUD Act be scrapped as it violates Articles 14 (right to equality) and 21 (right to life) of Constitution. In the petition, filed through advocate Vijay Nangesh, Prajapati contends that the provisions of the Act contradict its `parental acts', which are Bombay Provincial Municipal (BPMC) Act and Gujarat Town Planning and Urban Development (GTPUD) Act. Division bench of acting Chief Justice Bhaskar Bhattacharya and Justice J B Pardiwala issued notices, and asked respondents to file reply in four weeks. (More)PTI PB PD KRK
