Notice to Monserratte, others for bid to free accused

Panaji, Aug 19 (PTI) A local court today issued notices to Goa education minister Atanasio Monserratte and others for allegedly attempting to take away an accused from police custody last year. Judicial Magistrate First Class, Panaji issued the notices after Central Bureau of Investigation (CBI) filed a chargesheet against the minister, his son and the then mayor in June this year. Besides the minister, his son, Amit and the then Mayor Tony Rodrigues are accused of attempting to free Mainardo alias Toto from police custody on February 19, 2008 following an attack on the Panaji police station by a mob injuring several policemen. Monserratte, his Jeniffer and Amit were amongst several people arrested for mobbing the policemen. The court today served notices under IPC Section 353 (assault to deter public servant from discharge of duty) read with Section 34 (act done by several persons in furtherance of common intention). "They entered the police station and attempted to take away the arrested accused and obstructed the complainant, a police inspector, and other cops in discharge of their duties," said the chargesheet, which names 37 including current mayor Caroline Po. They are accused of rioting, attack on public servants with dangerous weapons, causing mischief by damage to public property and also use of fire and explosives. Initially, the case was inquired by state police and later handed over to CBI.
