The Bench said despite the objections and embarrasment, the

Judges orally informed the counsel concerned that since the Chief Justice had posted the petition before them they would hear it. The reason for the objection was related to an interim stay of proceedings issued by the judge in another case. Counsel for the petitioner had requested the Chief Justice to record their reasons for objecting the Judges from hearing the petition. When the Bench asked the Chairman of the Bar Council of Tamil Nadu, D Selvam about the matter, he said such kind of practice by a few lawyers should be stopped immediately and be dealt with sternly. He submitted that such lawyers should be punished and they should not be allowed to get away by tendering apologies. The Presidents of the Madras Bar Association, Madras High Court Advocates' Association and Women Lawyers Association fully supported the Bar Council Chairman’s view. They assured that their respective associations would not support such lawyers. Senior Advocate, R Gandhi also condemned such letters being written to the Chief Justice maligning Judges. The Bench said after considering the contents of the letter, it it was of the prima facie view that a clear case of criminal contempt was made out. It appreciated the gesture of the advocates associations and the Bar Council for expressing their willingness to assist the court. The Advocate General would assist the court as amicus curiae. It also ordered notice to the two advocates and the petitioner to file their reply within four weeks. The bench also directed the registry to place before the court some similar letters written by other advocateas on the next hearing date. PTI GR RC
