Bhopal gas tragedy justice undelivered

Bhopal: Twenty five years on, the victims of the Bhopal gas leak tragedy are still crying for justice.

The main accused, Warren Anderson, the former CEO of Union Carbide is yet to be brought to book.

Activist Satti Nath Sharangi said, " The Indian Government's attitude towards extraditing Anderson has been lackadaisical. Nonbailable warrants were issued against him in 1992 and it took 11 years for the Indian Government to forward an extradition request which of course was denied."

The criminal case registered over the death of 30,000 people is still being heard at a local court in Bhopal.

Since December 1 1987 the prosecution has produced 178 witnesses while the defence has presented just 4.

No representative of Union Carbide America or Union Carbide Eastern Hong Kong, has ever appeared in court.

Union Carbide America claims it is not subject to Indian laws. Frustrated, the victims had filed a case in an American court but that too has led nowhere.

Attorney Rajan Sharma said, "Our argument is that if you do not submit to Indian jurisdiction than you have to submit to American Jurisdiction and the American courts have to do something about it."

Many who survived the tragedy, have now passed away but their fight is now being taken up by a younger generation of victims.

The search for justice for the Bhopal gas victims looks like an hopeless idea with every passing day, but they have no escape from fighting for justice because the gas that killed thousands 25 years ago has hit the survivors in their genes and no one knows for how many generations the effects will be felt.
