New Delhi: The Supreme Court on Tuesday is expected to pronounce its order on framing guidelines when it comes to granting sanction to prosecute a public servant. This in response to a petition filed by Janata Party President Subramanian Swamy in the 2G scam case.
Swamy had moved the court in 2010 alleging a delay by the Prime Minister's Office to give him sanction to file a case against former Telecom Minister A Raja.
Swamy's arguments were that he wrote to the PMO on November 29, 2008 but it was only on March 19, 2010 the PMO replied that the plea made by Swamy was "premature" as investigation was being carried out by the CBI.
However, during the course of arguments in the Supreme Court, the court had made some adverse observations against PMO and said, "For good governance there must be some time-limit for granting sanctions."
The question that will be answered by the Supreme Court verdict is how long can an authority sit on a request seeking sanction to prosecute a public servant.
