New Delhi: Mahinder Kumar's family's 19 years of wait is finally over as a trial court in Delhi has sentenced retired ACP R P Tyagi to death for killing Kumar in custody.
Tyagi was the Station House Officer (SHO) of Vivek Vihar thana where Kumar was killed during interrogation. The other two accused – retired ACP K P Singh and sub inspector Tej Singh have also been found guilty.
"This was not rarest of rare crime. He was doing his duty. The people killed are also criminals. We will appeal in high court," said Defence Councel Jay Gopal Garg.
On August 16, 1987 Kumar got into a scuffle with a constable of the Vivek Vihar police station in east Delhi.
He surrendered a week later and was brutally beaten up while in custody. The next day on August 25 Kumar was rushed to a hospital where he succumbed to his injuries.
The postmortem report revealed 44 injury marks on his body but the police refused to register an FIR. And it was only after court intervention that a case was filed.
"Our 19 year long struggle has finally paid off. My father died in the course of this struggle. He would have been a happy man," said victims' brother Rajendra Kumar.
ACP Tyagi now has 90 days to appeal in the Delhi High Court.
