Click to play videoNew Delhi: Medical Practitioner Dr Binayak Sen is ailing and fears a heart attack. He has spent almost two years in prison now. The Raipur High Court that denied him bail is now dragging its feet on granting him medical treatment at a hospital of his choice.
Sen was arrested under the Chhattisgarh Special Public Security Act and the Prevention of Unlawful Activities Act.
he has been denied bail twice, on February 20 he filed an application seeking medical treatment saying he feared a heart attack.
The Court simply said to do what was required but things are simply not moving fast enough and the doctor can feel his body slowly giving away.
Binayak Sen "My health is failing and I fear a heart attack," said Dr Sen.
As an under trial, Binayak has the right to treatment at a hospital of his choice at his own expense. He trusts only the CMC, Vellore. not wanting to risk his life in the Chhattisgarh government hospital the cardiologist who checked Binayak Sen on March 25 advised that him to be taken to C M C Vellore for an angiography and if required a bypass surgery.
But Binayak is still languishing while the Court is makes up its mind.
"Every under trial and even a convict has a right to medical treatment by a doctor of his choice and in a hospital of his choice ... any delay in treatment could lead to permanent damage and then the state is responsible," said Prashant Bhushan.
Every Monday since two weeks a quiet Satyagraha is happening in Raipur. Groups of writers, filmmakers, activists march towards the Raipur jail and court arrest demanding that Dr Sen be released.
Dr Binayak Sen preferred to work among the poorest in remotest parts of the country. Reaching medical help to those who had no means at all, fusing health with human rights. Binayak's failing health tells us about the health of our democracy.
