New Delhi: One day before Gujarat goes to polls all eyes will be on Chief Minister Narendra Modi, as the Supreme Court will hear two petitions against him on Monday in the Sohrabuddin Sheikh fake encounter case.
The apex court will hear an application filed by noted lyricist Javed Akhtar and Sohrabuddin's brother Rubabuddin Sheikh, who have demanded that Modi should be included as a co-accused in the fake encounter case.
"He is publicly condoning and propagating murder. This is shocking and has to be checked. I'm sure it’s a crime under the Indian Penal Code. I would appreciate it if SC stops him from such kind of canvassing,” said Akhtar.
Any move on the issue in the Supreme Court could affect the electoral battle in Gujarat.
A team of the Election Commission (EC) is also visiting the state on Monday. The Commission is to review preparations ahead of the first phase of polling on Tuesday.
A bench ordered for listing of the petition moved by Rubabuddin Sheikh on December 10. Rubabuddin in his petition said that the speeches of the Chief Minister show that he appears to have been at the centre of the fake encounter of his brother.
The petition also asked for a fresh FIR against Modi and said that investigation be handed over to the CBI.
“The petitioner submits that the utterances made by the Chief Minister justifying the killing of my brother and thereafter challenging constitutional functionaries of hanging him clearly demonstrates the scant respect he has for the rule of law and this honourable court,” said the petition.
The state government has been submitting before the apex court that Sohrabuddin was killed in a fake encounter whereas Modi had recently glorified the killing by the police and said, ‘hang me if I have done anything wrong’.
