Amicus report, a fresh trouble for Narendra Modi

New Delhi: There is fresh trouble for BJP poster boy and Gujarat Chief Minister Narendra Modi in the Gujarat riots cases.

According to Amicus Curiae report of the 2002 Gujarat riots case, the case against Modi cannot be closed.

The report authored by Supreme Court senior advocate Raju Ramachandran indicates that Modi could be prosecuted under Sec 153 and 166 IPC for promoting enmity among communities and failing to discharge duty as public servant.

The report says there must be further cross examination of all witnesses including suspended IPS officer Sanjeev Bhatt.

The report also says that it is not possible to close the case as there is evidence for prosecution to be initiated not just against Modi but other ministers also.

This Amicus report directly contradicts SIT report that had earlier probed allegations against Modi's administration and said that despite ghastly violent attacks on Muslims in Gulburg Society and Naroda Patiya the reaction of the government was not the type which would have been expected of anyone.

However, the report didn't ask for prosecuting him further due to lack of evidence.

But now human rights activists are calling this report as a fresh lease of life for cases against Modi and other accused in the case.

Now, both the SIT and Amicus reports will be placed before the trial court in Gujarat and that's where the court and prosecuting agencies will have to decide how to proceed further.

So, it's not guaranteed that Modi has to be chargesheeted, but clearly his hope of putting the 2002 riots to rest has been dashed since further investigation will now be necessitated.-
