New Delhi: The Delhi Bar Council has issued showcause notice to defence counsel R K Anand and I U Khan, who was the public prosecutor in the BMW Case before being dropped by Delhi Police.
Both Anand and Khan were caught on camera colluding to save Sanjeev Nanda — main accused in the case — in a sting operation.
They have been asked to appear before the council on July 20.
The decision to issue the notices to the two lawyers was taken after an hour-long meeting in which 20 out of 25 of its members were present, Delhi Bar Council Chairman K K Manan said.
The notice has been issued under Section 35 of the Advocates Act, which deals with the professional misconduct.
A committee comprising – C L Sachdeva, Surya Prakash Khatri and R S Rana – was constituted to inquire into the matter following the allegations levelled against fellow criminal lawyers in the expose.
The committee – which had gone through the CDs of the sting operation – was also of the unanimous view to send show cause notice to the noted lawyers.
Former Chief Justice of India J S Verma says this incident could be a dent on the judiciary's credibility.
"Every step that can be taken should be taken so that there is no further erosion of credibitlity. Although the judiciary is beyond reproach, there are some occasions where there is resonable grounds, which need to be identified and eradicated," said Verma.
Both I U khan and R K Anand refused to comment on their future course of action, but with two judicial, one police and now a bar council enquiry pending against them, it looks like these two eminent lawyers will have to garner all their legal acumen to come clean of the charges leveled by Sunil Kulkarni.
