Anna to go ahead with fast; Bombay HC rejects petition

Mumbai: The Bombay High Court on Friday dismissed Team Anna's petition asking for a fee waiver at MMRDA Grounds dealing a blow to India Against Corruption. The court said they were not eligible for a waiver as they had not applied through a registered organisation.

Mayank Gandhi, IAC said, "We came with a hope, but the HC has observed that it is not under its purview to grant such a concession."

But this was not all, the court came down heavily on the planned protest as well.

As soon as the hearing began, the judge asked IAC why they were planning an agitation at a time Parliament is discussing the Bill.

The court even mentioned pollution and law and order issues with respect to Azad Maidan and said everyone might not want IAC's Satyagraha.

The court said it was beyond its purview to decide on the issue of concession and with IAC not registered as a social organistaion, it was the MMRDA's discretion to decide on the rates applicable.

The court also said it had no records to prove IAC is a social organisation and whether its protest is in the national interest or politically motivated.

With the court granting no relief and Anna Hazare appealing for donations, it seems it is now upto Anna's supporters across the country to ensure the fast goes on smoothly.

The MMRDA has agreed though to give Team Anna lower rates if they apply through a registered NGO, after which they have decided to apply through Arvind Kejriwal's NGO. The approval, if it comes, will save Team Anna around 4 lakhs.
