New Delhi: The key witness in the Nitish Katara murder case, Bharti Yadav, has sent a fax to the Patiala House court in New Delhi, saying that she is ready to depose in the Nitish Katara murder case through a video conference.
The fax has been sent from an undisclosed location in the UK.
Bharti has not appeared before the court though several summons have been issued against her in the last three years.
Bharti is purportedly pursuing studies in London and her passport was revoked on March 7 this year. Her testimony is believed to be crucial for proving the motive behind Katara's murder.
On July 15, Bharti's father D P Yadav - a former Rajya Sabha MP - told the court that he met her at a function in London but refused to say where she lived. The court on May 16 ordered D P Yadav to appear in person since Bharti's present address was not traceable.
Earlier, the Home Affairs Ministry had submitted that Bharti no longer resided at her last-known London address in their records.
According to the prosecution, it was Bharti's friendship with Katara and the disapproval of this friendship by Bharti's brother, Vikas Yadav, which led to Katara's murder.
Nitish Katara was allegedly kidnapped and murdered by Vikas Yadv, on the night of February 16-17, 2002 from Ghaziabad, Uttar Pradesh, where he had gone to attend a friend's wedding.
On Friday , the Government had informed the Supreme Court that it planned to issue a red corner notice against Bharti.
The court had also turned down the defence’s request that Bharti be examined through video conferencing.
Additional sessions judge, Ravinder Kaur, has fixed July 29 for the decision on the prosecution's application for issuing a proclamation against Bharti.
The Delhi court reversed the trial court's decision to drop Bharti as a witness and gave the trial court can resort to any means to secure her presence in the court.
In fact, a Delhi court on Thursday reserved its order on a prosecution application to declare Bharti a proclaimed offender.
