New Delhi: The Central Forensic Science Laboratory (CFSL), Chandigarh has said that the Shanti Bhushan CD - that showed senior lawyer Shanti Bhushan promising to fix judges - was doctored.
Though the CFSL, Chandigarh report contradicts other forensic lab reports, father-son duo of Prashant Bhushan and Shanti Bhushan now using the particular report, obtained through RTI, as a vindication of their stand that they were being targetted by the Government.
The police had told a court in August this year that the CD showing Bhushans in conversation with Amar Singh and Mulayam Singh Yadav was genuine. But now, the CFSL, Chandigarh report questioned the Delhi police's claim.
"We have been always saying that the CD was fabricated. Delhi report claimed that the CD was genuine, which was made public to media by Delhi Police," said Prashant Bhushan.
So, what was the CD controversy all about?
The CD had Shanti Bhushan telling Amar Singh and Mulayam Singh Yadav that a Supreme Court judge could be fixed for Rs 4 crore.
The Delhi Police sent the CD to central forensic labs in Chandigarh and Delhi for examination.
While the Delhi CFSL lab said the CD was genuine, the Chandigarh CFSL lab stated that the conversations had been edited and had been tampered with.
The Delhi Police then sent the CD for examination to the Indian Computer Emergency Response Team (CERT). The CERT too opined that the CD was genuine.
So it was two labs verses one. Sources also saying that the opinion from the CERT was given more weightage as it is the nodal agency for cyber security related matters and that the agency gave an opinion only after a board of five experts examined it.
"Chidambaram took an immense interest into the case; this shows how the present Government is involved in such frauds," said Prashant Bhushan.
So, what happens from here on? The court has three options. It can either accept the report and order the police to file an FIR against Shanti Bhushan for filing a false complaint, or reject the report and order a re-investigation investigation or ask the police to probe corruption charges.
