Buddha bows, drops judicial probe into Rizwanur death

Kolkata: West Bengal Chief Minister Buddhadeb Bhattacharya has withdrawn a judicial inquiry into the death of Rizwanur Rahman, a computer graphics teacher who died after alleged police harassment to leave his Hindu wife.

"After considering all aspects, I am withdrawing the judicial probe that was ordered earlier. We went by the mood of the people, the media opinion and above all wishes of the family of Rizwanur who only want a CBI probe," Bhattacharya said.

Rizwanur, 30, was found dead beside a railway track in Kolkata with his head smashed on September 21, barely a month after marrying Priyanka, daughter of a powerful industrialist.

Rizwanur’s elder brother, Rukbanur, and mother, Kishwar, on Thursday filed an appeal in the Calcutta High appealing that the judicial probe be withdrawn.

Bhattacharya had ordered a judicial inquiry along with a Criminal Investigation Department (CID) investigation, which the Calcutta High Court scrapped. Instead, the court ordered the CBI to probe the death.

"When the CBI has started investigation there is no point in continuing the judicial probe which had also started formally. We are withdrawing the government notification for the judicial probe," Bhattacharya said.

Rizwanur’s family claims judicial commission set up on October 1 had no legal validity as a state appointed commission had no authority to interrogate IPS officers.

The petition also stated the judicial commission has no right to conduct the probe since the high court has already asked the CBI to investigate the matter.

The state government removed five police officials—Police Commissioner Prasun Mukherjee, deputy commissioner (headquarters) Gyanwant Singh, deputy commissioner (detective department) Ajoy Kumar, assistant commissioner of Anti-Rowdy Squad (ARS) Sukanti Chakraborty and sub-inspector Krishnendu Das of the same department—on October 17, 26 days after Rizwanur was found dead.

The CBI has sent Rizwanur’s computer to a private lab in Hyderabad for examination by forensic and cyber experts. Experts will also examine all telephone calls and SMSes made from Rizwan's mobile phone.
