Could it be that the CBI has buckled under political pressure?
This is what the Supreme Court told Subba when his case was heard: “It is highly suspicious how you came to India and how you got Indian citizenship. We take a very serious view of it."
The apex court also pulled up the CBI for making a mess of the Subba investigation. For instance, the CBI says: "MK Subba states he was born in Dabgram, but we have no evidence to confirm or refute his claim"
But CNN-IBN Special Investigation shows how Subba, at different times, has claimed four dates of birth and three birthplaces.
The CBI also says it could not locate a key person, A K Subba, to testify on Subba's nationality. "Present whereabouts of AK Subba are not available,” says the document.
However, CNN-IBN traced A K Subba in Sikkim, in just two days.
He now runs his business in Gangtok. The CBI also mentions a Sanjay Raj Subba who petitioned the Nepal King. An excerpt from CBI report: "His brother Sanjay Raj Subba prayed to the King of Nepal for the pardon of M K Subba alias Mani Raj Limbo"
However, Subba denies that the petitioner was his brother.

CNN-IBN: Sanjay Raj Subba, aapka bhai, jisne yahan nomination bhara. (Your brother Sanjay Raj, who filed the nomination?)
Subba: Arre, kitna Sanjay Raj hoga duniya mein. (There are many Sanjay Raj Subbas is the world!)
CNN-IBN also found that the CBI did question MK Subba's younger brother Sanjay Raj Subba now an Assam MLA - but forgot to ask him about the mercy petition.
Sanjay Subba refused to reveal any further details.
“Mere paas kya hai, kya nahi hai, vo main aapko nahi kahunga. (I will not say anything to you. I will answer if there is an enquiry.),” said S R Subba.
However, when he thought the camera was off, he offered the SIT a bribe.
Subba: Kharcha hai? (Are there expenses?)
CNN-IBN: Ye kis liye? (What for?)
Subba: Umm, kharcha. (Your expenses.)
CNN-IBN: Wo to company deti hai. (My company gives me that)
Even his brother M K Subba tried telling the team to drop the story.
Subba: Aapki masikta hai, to thanda baitho. (If you have brains then sit calmly on this.)
Clearly the Subba brothers have a lot to hide and the CBI's shoddy investigation has only helped them.
The question is did Congress party lean on the CBI to go soft on Subba?
