Noida: Twenty-four hours ago, a triumphant UP Police force announced a breakthrough in the controversial Noida double murder case.
In a sensational revelation, Gurudarshan Singh, Inspector General of Police, Meerut Range, addressed the media to disclose that Arushi Talwar has been murdered by her father Dr Rajesh Talwar.
He went on to reveal the sordid tale of how Dr Talwar first killed his manservant Hemraj and then his daughter by slitting their throats.
The revelation had the nation transfixed to the presser on TV, shocked and in disbelief.
However, a day later, even after they have taken Dr Talwar into custody, Noida police have much to answer.
Weak evidence
Nearly 24 hours after police claimed to have cracked the Noida double murder case, holes are being punctured into their story. The police arrested Dr Rajesh and sent him to Dasna jail but lawyers question the basis of the arrest.
"There is no evidence and my client is innocent," Dr Rajesh's advocate Abhijeet Chatterjee claimed.
Dr Rajesh has also filed for bail in a local court claiming he is totally innocent and that he also suffers from asthma.
The application of Dr Rajesh, who was remanded to judicial custody on Friday, is expected to come up for hearing on Monday.
Motive not clear
For a conviction in any murder case it is important to prove the motive of the crime. Noida police gave two motives - Arushi did not approve of Dr Rajesh Talwar's affair with his colleague Dr Anita Durrani and the fact that he was enraged after seeing his daughter and servant together in an objectionable position.
Dr Anita Durrani, however, denied the first motive, on Saturday
"There is no truth in the allegations. It's all false. I have been known him (Dr Rajesh Talwar) for the last 10-15 years. We are very good and close family friends," Dr Anita said.
So far police seem to have no direct evidence in the case. The murder weapon, cell phones of the deceased and the clothes Dr Rajesh was wearing when he allegedly committed the murder have not been recovered.
The post mortem report has also been questioned.
Talwars' driver could have been a crucial witness since police say he last saw Arushi alive with her parents.
But Arushi's mother Dr Nupur Talwar is not a co-accused in the case so far. She said that that her husband is innocent.
"My life has been completely collapsed. A normal family has been completely destroyed. My husband is innocent and I know that. As a mother and a wife, I know that. All I can say is please everyone out there pray for Arushi's soul, pray for Rajesh and pray for my family. I have full faith in the judiciary of this country and full faith in God. And I'm certain that truth is going to prevail," she said.
In case she becomes a defence witness the prosecutions' case is weakened further
"Merely on the base of presumption, conviction cannot be held. Conviction on circumstantial evidence has to be held on the base of reliable and admissible evidence," lawyer DB Goswami said.
The Noida police have now moved court seeking police remand of Dr Rajesh Talwar so that evidence can be recovered at his instance.
A week after Arushi was killed loopholes seem to be plaguing Noida police's theory. It looks like they will have to do a lot of catching up to ensure that the case stands judicial scrutiny.
