Damning evidence against Ansals ahead of Uphaar verdict

New Delhi: It could just be the most damning evidence against the Ansals. The Association of Victims of the Uphaar Tragedy has dug up evidence which may be hard for the courts to overlook.

Three years back, the Supreme Court had allowed the Ansals to mortgage Uphaar cinema after they said they didn't have the money to pay Rs 3 crore as compensation to the victims.

The Ansals mortgaged the cinema to HDFC Bank. But here's the catch.

Says President, Association of Uphaar Victims, Neelam Krishnamoorthy, "The most important thing is that Uphaar being a case, the property cannot be mortgaged. The property has been mortgaged and the courts were not informed."

Documents in CNN-IBN's possession show that the Uphaar building had already been mortgaged to the Punjab National Bank for Rs 43 crore in 1996 -- a fact the Ansals did not disclose in court.

And there's more. In this letter submitted by the Ansals to the Supreme Court, they have said that the Punjab National Bank had released Uphaar from the mortgage in 2003.

However a document from Punjab National Bank shows that the building was still mortgaged to it in 2006.

Says Neelam Krishnamoorthy, "Another shocking thing is both the forms, the one with Punjab National Bank and the other with HDFC Bank are not the same. The actual sale deed number of Uphaar is 6738, but the sale deed number in the HDFC form is not the same."

And it gets worse. The deed given to HDFC bank is actually for a property located elsewhere, owned by a retired Army officer.

Foulplay revealed through the documents suggest a clear contempt of court case. Now the Uphaar victims have filed a petition in the Supreme Court which is coming up for hearing on September 20, where they have demanded that an independent investigation be set up and contempt proceedings be initiated against the accused.
