Teen arrested in Delhi road accident case

New Delhi: A 16-year-old is facing trial for ramming his father’s Scorpio into a Maruti and killing five members of a family. But the surprising part of the case is that according to the Motor Vehicles Act, his father is liable to three months imprisonment for allowing his minor son to drive and might be let off with a fine of just Rs 1000.

The Gargs are inconsolable after five members of the family were killed in a brutal car accident on Thursday night. A 16-year-old driving his father's Scorpio rammed into Garg’s Maruti 800. Their tears have now given way to anger and frustration. The family wants justice.

“We want them to be hanged,” says victim’s mother.

Meanwhile, the 16-year-old accused of being at the wheel of the Scorpio was produced in a juvenile court on Monday. His judicial custody has been extended till December 24.

The father of the accused, Brahm Prakash Chaudhry, could get away with a fine of as little as Rs 1000, since as of now the Delhi Police has only charged him under the less stringent Motor Vehicles Act.

“We will see what charges can be applied as per the course of the investigation,” says DCP north west NS Bundela.

Legal experts have come forward in their criticism of the Delhi police for the way they have handled the case.

“As a member of the civil society, its appalling that you will let people get away with this kind of behavior, when clearly there are provisions in the law which can be used to set an example,” says senior advocate KTS Tulsi.

Senior police officials told CNN-IBN off the record that provisions of the relevant Motor Vehicles Act are weak for the Delhi police to take strict action against the accused.

Meanwhile, the boy has been charged for rash and negligent driving and culpable homicide not amounting to murder but being a juvenile, if convicted he will be sent to an observation home.
