Drunken driving: the police was wrong

Mumbai:As part of their hugely successful drive, the Mumbai traffic police have nabbed many motorists over the past year for drunken driving.

And also in the list were Divesh Bhal and Avinash Kumar, who failed the breath analyser test and paid two thousand rupees each to avoid going to jail.

However it seems, the duo weren’t drunk. In fact, they took the matter to court.

“He asked me to go through the breath analyzer test, so I said no problem, I went through the test, then the officer said that I'm positive and I was shocked,” says Divesh Bhal.

“I was not sure if he had drinks, but I was sure that I had not, so I asked them to test me, but I was shocked when my test also came positive,” says Avinah Kumar.

“If the breathalyzer is saying that they are drunk, how do I dispute that?,” says DCP, Traffic, Mumbai Police, Harish Baijal.

After paying their fines, the duo headed straight to reputed pathology lab for a blood test, which concluded that they were not drunk. A case of over-zealousness from the police or if the analysers are indeed faulty, Divesh and Avinash are only a fraction of innocent motorists wrongly charged.
