General students to get vacant OBC seats

New Delhi: The Supreme Court on Monday ruled that seats remaining vacant after implementation of the 27 per cent quota under a Parliament-enacted legislation for the Other Backwards Castes at Indian Institutes of Technology (IITs) and Indian Institutes of Management (IIMs) would go to students of the 'general' category.

"There is no confusion about our judgement that seats which remain vacant after the implementation of the 27 per cent quota will go to the general category," a bench headed by Chief Justice K G Balakrishnan said.

The ruling is applicable only for the current academic year.

Earlier this year, more than 400 seats of the reserved quota were said to be lying vacant in various IITs.

The Joint Admission Board of the IITs had decided to transfer the vacant seats to the next academic year.

The bench had on April 10 upheld the validity of the Central Educational Institutions (Reservation in Admissions) Act.

The Central Government has got time till September 29 to find out if any seats in any of the IITs and IIMs against the reserved quota are lying vacant or not.
