Ghaziabad: From being suspects to now being the accused - Dr Rajesh and Nupur Talwar have been charged with murder in the Aarushi-Hemraj double murder case. This was the special CBI Court's order after hearing the arguments on the closure report.
"The court has taken cognizance of the CBI report. The court has taken cognizance of offences under Section 302, 201 read with 34 IPC and summoned Dr Rajesh Talwar and Nupur Talwar as accused in the case for February 28," said CBI lawyer RK Saini.
The order surely came as a huge surprise as the CBI had filed a closure report stating that though there was circumstantial evidence pointing towards Talwars, there was no clarity on the motive and the sequence of events and that's why it was difficult to chargesheet them.
But what came as a greater setback for the Talwar family was Nupur Talwar being named as an accused.
"The parents have only been summoned. We will see what happens on the February 28. We will deal with it. There is no question of arrest of parents. It was apparent the blame games CBI played in the court. It's not a final order. We propose to challenge it in a superior court," said Talwars' lawyer Rebecca John.
The Talwars said they were being maligned by the CBI.
"My question is why have we victimised? What have we done, they have lost their child and can the parents ever do this? Why the nation maligning us? We went to CBI as it is the highest investigating agency in the country, and what has the CBI done - one lie after another? We have nothing on our side but the truth and we will fight for it till the end," said Vandana Talwar, sister-in-law of Rajesh Talwar
The lawyers of Krishna Rajkumar and Vijay Mondal and the UP Police, which had been slammed for shoddy investigations, however say they feel vindicated today.
"Whatever evidence the CBI gathered goes against Rajesh Talwar and Nupur Talwar," said lawyer FC Sharma.
"I would just reiterate that our investigation was always very professional, number 1. Number 2, it was with malice towards none and in the right with due emphasis and its evaluation, logistics and back up and support," said former DGP Vikram Singh.
The Talwars will now prepare to challenge the order in a higher court. They will again try to point out that the CBI needs to reinvestigate this case. But for now they will have to appear before the Ghaziabad court on February 28 as the parents accused of murdering their child and their servant.
