Gays hoeful of a better future in 2009

New Delhi: The year 2008 saw the Gays and Lesbians in India come out as never before and for the first time it seemed that Article 377 which makes homosexuality illegal might be scrapped sooner or later.

It might be the final lapse of the seven-year-old legal battle. They say that 19th century law which makes homosexuality a criminal offence under Section 377 of the IPC must be reformed.

“This has to go, controlling the private lives of the people. The law shouldn’t enter the bedroom of the people,” says a lawyer Anand Grover.

The issue of homosexuality has divided the Government. It has pitted the Health ministry against the Home ministry and has turned into a morality versus health debate.

The US gay-rights movement has progressed to the wedding altar, that might not happen soon for the gay community in India but they will continue rallying hard to secure their rights.

“Right to adoption, partnership rights, example inheritance rights - all these are rights given to individuals irrespective of sexuality. In 2009 I see with the maturing of the movement with the maturing of people demanding rights being open about it. I see a lot more of these coming to the fore and people claiming rights,” says a gay Aditya Bandopadhyaya.

Even as India debates gay rights, it has already become home to gay parenthood. In 2008 this Israeli gay couple had a baby through invitro fertilization in Mumbai.

In 2006 these two tribal lesbians ran away from their village only to be get accepted later. In 2008 gay, lesbians and transgender walked the streets holding hands.

“The year 2008 has been about euphoria coming out and saying we exist. The year 2009 will be a maturing process,” adds Aditya.
