New Delhi: The battle for spectrum will resume in courtrooms after a Government-appointed committee submits its report on spectrum allocation. The case is slated for its next hearing on the December 12.
On Monday the battle for spectrum shifted from the corridors of power to the courtrooms. Nothing unexpected happened though with government assurance that no spectrum will be awarded until December 12.
That's when the case is due to be heard again. The gap of almost a month is because the committee, set up by the government, which includes industry representatives and scientists, will submit its report in two to three weeks.
Government of India Solicitor General G Vahanvati said, “No spectrum allocation till committee comes out with policy and that is subject to the orders of the TDSAT."
While a pause on spectrum allocation will come as some relief for private GSM players, their plea for a stay on issue for dual technology use was not entertained.
The government counsel said dual technology use was allowed keeping consumer interests in mind. Private GSM players fear the revised norms coupled with the government's move to allow dual tech use will catapult R-COM to the top of the queue for GSM spectrum.
Interestingly, Reliance Communications, HFCL and Shyam have also been made a party to the case.
Reliance Communications Counsel Harish Salve said, “They have been making so many accusations against us and its only fair that we be made a party to the case."
The battle lines are now drawn with private GSM players up against the government and Reliance Communications. This promises to be the mother of all telecom battles.
