Ahmedabad: With continuing politics over the appointment of Gujarat's new Lokayukta, the Narendra Modi government has challenged it in the Gujarat High Court, terming it unconstitutional. Gujarat has been without a Lokayukta for more than seven years.
When a delegation of Congress MLAs called on Gujarat Governor Dr Kamala on Friday to submit a memorandum, demanding the appointment of a Lokayukta, they were in for a surprise. The Governor informed them that he had already issued a notification, appointing retired High Court judge Justice R A Mehta as the new Lokayukta just the previous day.
Shaktisinh Gohil, Leader of Opposition, Gujarat Assembly, said, "We have made several representations for the appointment of Lokayukta, but the government did nothing. Now seven and a half years have passed. Finally, the Governor has appointed a Lokayukta who has been suggested by the Chief Justice of the Gujarat High Court."
Gujarat Government spokesperson Jaynarayan Vyas said, "The question is that you are not following the procedure. The Governor is supposed to act as per the advice of the Council of Ministers. And you are not doing that. It is bad in the eyes of law and we are examining the pros and cons of it and appropriate action will be taken."
This is the first site of dispute between the Gujarat government and the Governor who have otherwise enjoyed a cordial relationship. The matter will now come up in the High Court on the August 29.
