Hannah Foster case: Hurdles in the way

New Delhi: Maninder Pal Kohli, who is accused of raping and killing Hannah Foster, a teenager, in the UK in 2003, can stay in India for the time being.

The Delhi High Court on Monday stayed a lower court's order allowing Kohli's extradition to the UK.

The HC is hearing a writ petition filed by Kohli challenging the extradition order passed on the June 8.

The defense is questioning the evidence gathered so far in the case. “We have an issue with the evidence, we don’t even know if it is correct or not. He cannot be extradited on that basis,” said defense counsel, Charanjeet Singh.

The prosecution, which has been asked to respond by the July 6, is aware of the obstacles in its way.

"The number of calls and the timing are inconsistent with the route Kohli took, the DNA samples and the affadavit filed by the accused's wife,” said prosecution lawyer Anand Jha.

After three long years of trial, the sense of relief for the Foster family seems to have been short-lived.

The stay on the extradition of Kohli is just a small hint of the many hurdles still ahead before the prosecution. The case is far from over.
