New Delhi: The Karnataka High Court has stayed the government ban on the sale and distribution of lottery tickets. The interim order came on two writ petitions, one from the Arunachal Pradesh government challenging the notification.
In writ petitions filed by Arunachal Pradesh and others, the sellers claimed the notification issued under Section 5 of the Lottery (Regulation) Act "is illegal, arbitrary, incapable of being enforced and also violative of Article 14, 19 (1)(g), 301 to 304 of the Constitution".
The measure would result in the unemployment of various people and people will take to other forms of gaming, the petitioners contended while praying for the quashing of the notification.
Justice S Abdul Nazeer, after hearing the counsel for both sides, passed the interim order staying the notification and issued notices to the Central and state governments.
Judge Nazeer, in his order, allowed the respondents to move the court for vacating the stay or modification of the order and adjourned the petitions for being posted after the court's summer vacation.
The Karnataka government ban came into effect from April first.
