Ahmedabad: The political battle between the Centre and Gujarat government over the Ishrat encounter case has reached the court of law.
Centre on Wednesday filed a fresh affidavit in the Gujarat High Court in the Ishrat Jehan case putting the onus on Narendra Modi's government to justify the alleged fake encounter.
"Intelligence agencies regularly share intelligence inputs with state governments. Intelligence inputs are not evidence or conclusive proofs," said Union Home Minister P Chidambaram.
The first affidavit by the Union Home Ministry become a major embarrassment for the Centre as in it confirmed Ishrat's links with terror group Lashkar-e-Toiba.
The new affidavit though underlines that this information can not be an alibi to justify an alleged fake encounter.
Centre is also seeking an independent investigation possibly by the Central Bureau of Investigation (CBI) in the case.
"In order to damn Narendra Modi let IB be damned. Second is don't take information from Intelligence Bureau seriously," said Bharatiya Janata Party spokesperson Ravi Shankar Prasad.
With Centre having put the onus of the state, it is for the Gujarat government to justify the killings of Ishrat Jahan and those travelling with her five years back.
The next hearing of the case will be on November 30.
