New Delhi: A Division Bench of the Punjab and Haryana High Court on Monday night stayed an unusual order by a judge directing the CBI to admit a local advocate to Agra mental hospital.
Earlier on Monday, Justice Uma Nath Singh took suo motu notice of an FIR filed with the Chandigarh police against advocate Tahar Singh by his wife, alleging that he tortured her.
"In view of serious nature of allegations regarding beating and torture of the complainant and her children by the accused (Tahar Singh, Advocate) in a barbaric manner which only an insane person would do and further that, on enquiry, the Court is given to understand that even in the Bar, his conducts are aggressively violent, this Court is, prima facie, of the opinion, that accused is a worst case of mental disorder," Justice Uma Nath Singh said in his order.
The judge's order – that was in view of allegations of severe torture by his wife - also took note of his violent behaviour, as reported by the Bar.
The court directed the CBI SP "to immediately take Tahar in custody, and take him away from Chandigarh to admit him in the Mental Hospital, Agra for proper treatment" to ensure the safety of Tahar's wife and her children.
Following the order, CBI took Tahar Singh into custody and the party had reached Kurukshetra en-route to Agra when the single-judge order was stayed.
The lawyer lobby has now come out strongly against the Uma Nath Singh and has taken four major decisions:
- All lawyers will boycott Justice Uma Nath Singh’s court.
- Lawyers demand impeachment proceedings must be initiated against the judge.
- The lawyer lobby will appeal to Bar Council to not allot any work to Justice Uma Nath
- They say the judge requires treatment himself for having passed the obscure order
“The Bar Association has decided that Umanath's court be boycotted. We've requested CJ to withdraw all work from Umanath (sic),” says Advocate in HC Bar Association, Anupam Gupta.
Meanwhile, Rahar Singh has thanked the lawyer community for supporting him “I thank the bar assn and senior lawyers for helping me unanimously,” he said.
