Lawyer leaves Sohrab case after Modi's statements

MODITVA: Gujarat government's counsel K T S Tulsi has withdrawn from the Sohrabuddin case and wants Modi to clarify his stance.

New Delhi: The Election Commission is holding a meeting on the controversial speech of Narendra Modi justifying the killing of Sohrabuddin Sheikh.

The EC received a CD of the speech delivered at Mangrol, from the Surat Collector. The commission had said on Wednesday that they would investigate the matter only when they receive a report from the collector.

Meanwhile, the Gujarat government's senior counsel in the case, K T S Tulsi has withdrawn himself from the case, saying that he is unable to defend the state government when the Chief Minister of the same government give statements that make a mockery of the law and the Constitution.

“He (Narendra Modi) is the Chief Minister,” said Tulsi, “he has to uphold the law and the Constituion. His own government has filed several affidavits in the Supreme Court and his own government has filed a chargesheet against the officers, and charged them with murder - that this was a fake encounter in which Sohrabuddin was captured and then killed - murdered in cold blood.

Tulsi said that it will not be possible for him to resume the case till Modi clarifies his stance and apologises.

“The Chief Minister believes that this was the correct conduct,” he said. “I will not be able to fight this case on behalf of the state government unless there is an adequate clarification by the Chief Minister and there is a suitable apology.”

The BJP says that they won't comment on the lawyer’s decision to not continue with the brief. The party feels it's a matter between the Gujarat government and the lawyer in question.

However, fellow lawyer and Union Minister of Science and Technology, Kapil Sibal says that Tulsi had no option.

“It’s very difficult for a lawyer in such circumstances to defend a government which lauds, which congratulates those who were the government’s functionaries and who organised fake encounters,” said Sibal.
