Ahmedabad: Things are heating up for lawyers in Gujarat this summer. Most advocates of the Gujarat High Court are finding black gowns unbearable during summer months and are now trying to do away with their gowns.
But the Gujarat High Court has no rules under the Advocates Act that will exempt them from wearing the gowns in the four summer months.
"There has to be some drastic change. The British educational and legal system has been adopted blindly by us,” complains advocate Deepak Shukla.
Interestingly, there have been precedents when lawyers have tried to do away with their black coats. In 2001, BCI exempted advocates from wearing black coats during summers. The Chief Justice approved this for advocates in the lower courts. However, a two-member panel of the Gujarat High Court later opposed this ruling.
The Bar Council of Gujarat has now filed a writ petition in the High Court.
"The Bar Council of Gujarat has made numerous representations to the administrative side of the High Court and finally has filed this writ petition, praying that advocates be exempt from wearing coats in the summer season,” said advocate Prakash Jani.
The petition will come up for hearing on April 8, just when the summers start heating up.
