Goa's Children's Court had granted bail to Carvalho last week saying there is no prima facie evidence against him.
The alleged drug dealer was arrested on March 9, following two days of interrogation, for helping accused Samson D'souza, a local bartender, in drugging, raping and killing Scarlette on February 18.
But Carvalho maintains his innocence.
“There are sufficient grounds made out. First is defamation — both criminal and civil, and second is malicious prosecution,” Carvalho’s lawyer Peter D'Souza says.
Goa Police had claimed Carvalho gave Scarlette an overdose of drugs and then raped her. They said she was raped twice before being left to drown.
Carvalho was arrested on Wednesday night following two days of interrogation.
Fifteen-year-old British teenager Scarlette was found dead on Goa's popular Anjuna beach on February 18.
