Regulator tighten rules on pesky calls

New Delhi: If you are still getting calls from telemarketers in spite of being on the do not call list - there's good news for you. The telecom regulator will now penalise not just errant telemarketers but even the operator who carries unsolicited telemarketing calls.

The regulator says this is the only way to rein in the menace. The ‘National Do Not Call’ registry hasn't quite lived up to the reputation of putting an end to unsolicited calls.

So if you are a troubled user, here's how you can bring to book your errant operator.

Firstly you must be registered in the ‘National Do Not Call’ registry. You can do that by simply calling your operator.

It takes 45 days for registration to get activated. After that, if you continue to get a telemarketing call then you can complain to your operator within 15 days of getting that call. After two such complaints the telemarketer must be disconnected by the service provider.

If the menace continues then the operator himself will become liable for financial sanctions of up to Rs 20,000.

TRAI Chairman Nripendra Misra says, “It is an unprecedented step. We have imposed a financial disincentive."

Not surprisingly then, operators are miffed at this move. None of them would speak on record but they say they are mere carriers of calls and messages and cannot be penalised.

Operators could look at the option of dragging the regulator to TDSAT over this decision.

But it is, no doubt, a bold move by the regulator and one that is likely to be used as a testing ground for more such financial sanctions in order to discipline errant operators.

TRAI sources say that imposing penalties on operators for poor quality of service could also be considered.
