Khandwa: The legal battle over a two-and-a-half month old baby Shiv who was found abandoned in a rail compartment at Khandwa railway station has ended.

Two millionaire families - Ahujas and Gehlots - were locked in a court battle over Shiv. And now the Khandwa district court of Judge CS Tiwari has granted Shiv’s custody to the Ahujas. The baby is now undergoing treatment in a local hospital.

The judge said since Shiv was already in the custody of the Ahujas so he should stay with them.

The Ahuja family is understandably happy to get Shiv’s custody.

"Hamri doo beetiyan hain. Mein Shiv ko beta manti hoon. Mein Yashoda ban ker Shiv ko paloongi (We have daughters but no son. We wanted Shiv to be our son. We will bring him up well)," petitioner Anjana Ahuja said.

"Nayalay ne paya ki sanyukt parivaar mein accha parivesh hota hai, ekal parivaar mein aisa nahi hota. Court ne paaya ki Bhagwasdas ke parivaar mein unke do bade bhai bhi hain, do bacchiyaan hai to bacche ke parvarish acche se ho sakta hai. Ekal parivaar mein yeh sambhav nahi hai kyonki ekal parivaar mein mata pita ke upaar itni zimedarru hoti hai ki woh acche se dekh bhaal nahi ker sakte (The court observed that a joint family can take good care of the child which is not possible in a nuclear family. Since Bhangwandas Ahuja has two elder brothers and two girl child, so the boy will get a good environment," the lawyer for the petitioner said.

The baby was found in the Ratlam-Hingoli Express on the morning of February 18 by the railway police.

According to the passengers a woman had left the baby saying she would be back soon but when she did not return after several hours, the passengers began a search for her.

After a futile search for the woman the railway police were called and the child was taken to Khandwa district hospital where a nurse named him Shiv.

Shiv was taken to Bal Shakti Kanya Samiti and on April 6, the Samiti which is headed by the district collector handed over the child to the Ahuja family of Khandwa. There was another family from Mumbai that was related to the private secretary of a minister in the state Cabinate which claimed the child and then the matter went to the court.

The hearing of the case ended on April 26.
