Mirwaiz's US-born wife can stay in India: HC

New Delhi: Sheeba Masoodi, wife of Hurriyat Conference chairman Mirwaiz Umar Farooq, might not have to leave India after all. The Jamm and Kashmir High Court has stayed a deportation notice issued to her on October 4 asking her to leave India within 10 days or face legal proceedings.

Masoodi, who is an American citizen by birth, had applied for an extension of her visa but this wasn't recommended by the state government. Following the deportation notice by the state Government's Foreigners' Registration Office, Sheeba had filed a petition before the High Court.

She challenged the order saying she was entitled to stay in Kashmir as her father is an Indian citizen. Her counsel also argued that she could acquire Indian citizenship as she is married to a State-Subject of Jammu and Kashmir.

Justice Kakroo, who heard the appeal, has now stayed the deportation order. He also issued a notice to the Government of India, J-K government and other respondents for filing their objections within 15 days.

Some believe that the relief provided by the court to Mirwaiz's wife would also apply to others in the state facing a similar problem.

"This would finally become applicable to all others who have been served deportation notices after the expiry of their visas," said a lawyer, Khurshid Wani.
