New Delhi: Continuity with change is the mantra the Manmohan Singh Government has come with and the Law Minister seems to be working towards major reforms in the judicial system. The reformist Veerappa Moily wants to clean the system and change the controversial legacy of his predecessor.
starting with Justice Nirmal Yadav who has been accused of professional misconduct. But will the Supreme Court play ball?
The Centre wants to crackdown on judicial corruption, and Justice Nirmal Yadav case of Punjab and Haryana High Court is on the radar of Law Ministry. According to a highly reliable, top source in the the Union Cabinet, Moily is agreeable to the idea of pursuing the case against the judge under the scanner of the investigators.
- Justice Nirmal Yadav of Punjab and Haryana High Court is accused of professional misconduct
- The case is pending before the Chief Justice of India
- The CBI is likely to seek permission to look into the matter
- The Attorney General will advise on the issue
- The Law Minister has given his preliminary go ahead
Though Moily is not commenting on it, he has indicated that he is all for a clean and accountable judiciary.
"I think this is a question which I need to discuss with the judiciary and the Chief Justice of India. There is already a national debate on this subject and I think this is a matter which can be sorted out," says Moily.
The advocates in Chandigarh feel that this is a welcome decision.
Senior Chandigarh advocate, Anupam Gupta says, "It is a clear case of prosecution under the Prevention of Corruption Act. This should be made out against the sitting justice of the Punjab and Haryana High Court. Only the permission of the Chief Justice of India is needed as per the law laid down."
Moily is planninng a series of judicial reforms and he has already given enough indication that he wouldn't mind an impeachment case against Justice Soumitra Sen of Calcutta High Court. Action in the Nirmal Yadav case will be another step forward.
