Jaipur: The chances of the12-days-old abandoned baby joining her genetic father in Japan has dimmed. Documents with CNN-IBN show Manjhi's father's surrogacy agreement for her birth in India is invalid.
There seems to be no end to Manjhi's plight as her septicaemia infection has worsened, and lawyers are now saying that the surrogacy agreement under which she was brought into this world is invalid.
For one the agreement does not bear the signatures of her Japanese parents Dr Ikufumi Yamada and Yuki, who separated just a month before Manjhi was born.
The agreement was signed on June 13, 2008, six months after the embryo transfer to the Indian surrogate mother took place in November 2007.
"This agreement is nothing but a waste paper and the creation of such agreements comes under the creation for forged documents, which is an offence under Section 467, 471 of IPC," says advocate A K Jain.
The agreement also says that Manjhi's biological mother is not Yuki, but an anonymous ovum donor. This further complicates efforts in getting Manjhi's birth certificate issued.
However, there may be a solution in sight, as experts tell CNN-IBN a single parent like Dr Yamada could adopt the baby as per the Central Adoption Resource Authority guidelines of 2006.
Dr Yamada is extremely worried about Manjhi and has been calling up his friend, Kamal every hour from Japan to enquire about her health.
"I want to come to India as soon as possible. The baby is sick and she has been hospitalised, my mother is taking care of her, but she is in a strange country and is old so I'm very worried," he says.
As the legal wrangle gets more and more complicated for Manjhi who has gone through too much too soon, it's turning out to be a long wait before she may be united with her father.
