Mumbai: HC breather to forest area residents

New Delhi: The Bombay High Court has granted three months' time to residents of flats in forest areas in Mumbai to approach the Supreme Court.

Till then the Maharashtra government cannot take any action against the residents. The High Court had on Monday declared construction on private forestland in Mulund, Bhandup and Borivali illegal.

This means more than 1 lakh flats in the area are unauthorised. The state government had declared 120 acres of land in the city as private forest between January and May, 2006.

A division bench of Chief Justice Swatenter Kumar and Justice SC Dharmadhikari held the construction of several buildings in the suburbs of Bhandup, Mulund, Borivli, Dahisar and the Thane belt as illegal.

However, the Maharashtra government assured residents of those areas that are affected by the ruling that they would not be directed to evacuate immediately and steps will be taken to ensure that the forestland is regularised.

The judgement was pronounced by the High Court on a clutch of petitions filed in 2006 by Mumbai realty developers challenging the state government’s declaration that turned the already developed land into forestland.
