Murdered prof's son skips court

Ujjain: The son of Professor H S Sabharwal, who died after allegedly being assaulted by student leaders in Ujjain last year, has refused to appear before a court hearing the case.

Himanshu Sabharwal on Wednesday refused to appear before a lower court in Ujjain, alleging that the hearing was a “mockery of the judiciary and justice”.

CNN-IBN has learnt that the Madhya Pradesh Police’s Crime Investigation Department (CID), which is in charge of the probe, has questioned the way the prosecution is conducting the case.

At least five witnesses in the case have rejected their original statements, leading Professor Sabharwal’s family and friends to claim that the case is being hushed up.

Himanshu alleged that summoning him in the case was a ploy. “Since I wasn’t present at the time of murder, the minute I utter something it will be termed hearsay and that holds no value in court,” he told CNN-IBN from Ujjain.

“I was summoned abruptly and the prosecution hadn’t informed me. I’m not even on the list of witnesses that the CID has released,” he added.

“The case has been hushed up. The investigation has to be re-opened and given to an external agency,” Himanshu stated.

However, Public Prosecutor, Vikram Singh Sikarwar has said that Himanshu must come to court and present his side of story to get justice. He also said that Himanshu would be required to come to court and verify some document related to the case.

Prof Sabharwal died after BJP-affiliated Akhil Bharitiya Vidyarthi Parishad (ABVP) activists allegedly assaulted him on August 26, 2006 at the Madhav College in Ujjain.

A preliminary report in the case released on March 22 this year all blames the incident on police inaction. The report submitted by the Deputy Inspector General of Ujjain says the police failed to act firmly when student unions started protesting against cancellation of college election.

ABVP leader Vishal Rajoria, Shashi Ranjan Singh Akela and Vimal Tomar are among the six persons the CID has charged with the professor’s murder.
