Raipur: Rights activist Binayak Sen is all set to walk out of Raipur central jail on Monday. He was sentenced to life imprisonment after being convicted of sedition by a trial court in Chhattisgarh last December. The Supreme Court, however, granted him bail on Friday, while throwing out the sedition charge.
Illina Sen, Binayak's wife says that they will continue the work they have been doing until now, but it all depends on Binayak's health and mental condition.
"We will continue with our work but at what level remains to be seen. We will have to look at Binayak's health and psychological condition because what happened in November 2010 was a huge shock for everybody, especially for him and me. Because the case was so weak we expected an aquittal on charges of sedition, of charges on waging war against the state. Of course, he was acquitted on that. But the sedition charge was upheld. And we hadn't taken it seriously because it was so preposterous. I think the priority is to come to grip with ourselves but there's no plan to discontinue with our work," said Illina.
Dr Binayak Sen, a gold medallist from CMC, Vellore and a human rights activist, was convicted for sedition and sentenced to rigorous life imprisonment by a Raipur court on December 24, 2010.
Dr Sen was arrested from Bilaspur on May 14, 2007. The Supreme Court granted him bail on May 25, 2009. But, on December 24, 2010, he was convicted for sedition and sentenced to rigorous life imprisonment by a Raipur court.
His battle for bail began on January 24, 2011 when the Chhattisgarh High Court began hearing on suspension of his sentence. But on February 10, 2011, the High Court dismissed his bail plea.
The Supreme Court on March 3, 2011 admitted a special leave petition (SLP) and issued notices to the Chhattisgarh government, giving it four weeks to reply on Sen's bail plea.
On March 11, 2011 the prosecution asked for more time. Finally on April 15, 2011 a two-judge bench of the Supreme Court granted him bail.
