New Delhi: After the Delhi High Court and the trial court, even the Delhi Bar Council has taken notice of the BMW expose.
A three-member fact finding team has been set up to investigate the alleged nexus between the prosecution and the defense.
The tables have turned completely for the two senior lawyers. Used to putting others in the dock, they have landed up there themselves.
The Delhi Bar Council is investigating allegations of corruption against both I U Khan and R K Aanand, after a TV sting by the witness of the BMW case, Sunil Kulkarni, alleged that the two lawyers were colluding to save the accused.
The three-member fact finding committee comprising senior advocates, has been given two weeks to submit their report.
And the Bar Council Chairman indicates that the Bar will not hesitate to take appropriate action.
"People are speculating that we will not take action against our own brothers. But it is not true, if found guilty, action will be taken against them," said Delhi Bar Council Chairman K K Manan.
As per the bar council rules, Sec 35 of the Advocates Act can be revoked under which the license of the offending lawyer can be suspended or even cancelled if found guilty.
In case the Bar council of India too upholds the finding the lawyers may loose their right to practice any where in the country.
"This has happened in the past. In fact the Bar has cancelled the license of a chairman of the Bar Council also, because he was found guilty of misconduct," said Senior Advocate K T S Tulsi.
Both I U khan and R K Anand refused to comment on their future course of action, but with two judicial, one police and now a bar council enquiry pending against them, it looks like these two eminent lawyers will have to garner all their legal acumen to come clean of the charges leveled by Kulkarni.
But lost among all these investigations into the sting is the very basic question – was Sanjeev Nanda the driver of the black BMW, which killed six people on January 10, 1999?
