New Delhi: The Rajasthan Police reached Cuttack on Monday to arrest Orissa Home Guard DGP BB Mohanty. However, the team was informed that Mohanty was on medical leave.
Mohanty is accused of helping his son Biti Mohanty, convicted of raping a German scholar in Alwar, jump parole.
A day after Rajasthan Police were rapped by a Jaipur court, the state government on Friday had decided to send a police team to Cuttack to bring B B Mohanty to Jaipur for interrogation.
On Thursday, the Jaipur court had rejected Rajasthan Police's excuse of not having a court warrant to arrest the senior Mohanty, saying that the cops don't really need a court warrant to proceed against him.
The court of Additional Chief Judicial Magistrate Rajendra Bansal also rejected Rajasthan Police's plea to issue a non-bailable warrant against the DGP of Orissa Home Guard. The court said the Rajasthan Police was free to arrest Mohanty.
"We have come here to arrest B B Mohanty as per the court directions. We will take him to Rajasthan," said DSP, Jaipur, Mumkund Bihari.
For almost six months now, this case has been an embarrassment for the Rajasthan Government. Not only did Biti, convicted by a fast-track court for rape, jumped bail and disappeared, the senior Mohanty also sees the Jaipur court's order as a breather.
Meanwhile, B B Mohanty's lawyer has filed anticipatory bail plea in the Jaipur sessions court. The hearing is scheduled for May 30.
"Even if they come here, they have to immediately grant him bail because the charges are bailable. They are bound to release him unless they mischievously adds some more offence in it. At the same time when Section 130 is not made out against him, I doubt the intention of the Rajasthan police on putting this charge initially," B B Mohanty's lawyer Ashok Mohanty had told CNN-IBN earlier.
Rajasthan Home Minister Gulab Chand Kataria said the government has already decided to send a police team to Orissa to arrest the senior Mohanty and the team will be led by a Circle Officer.
Earlier, Orissa DGP Amranand Patnaik, however, told PTI that he had already discussed the issue with his Rajasthan counterpart MS Gill.
Asked why the Orissa cops were not cooperating with their Rajasthan counterparts in the case, Patnaik said his force would extend all possible help within the law to interrogate Mohanty.
Biti was convicted of raping a German tourist in Alwar. He has beenl on the run for the past six months and the police has no clue of his whereabouts.
