Click to play videoNew Delhi: Congress Member of Parliament from Tezpur, Assam, Moni Kumar Subba, can be prosecuted for cheating and forgery, the Central Bureau of Investigation (CBI) has told the Supreme Court (SC) in its report.
CNN-IBN has exclusive access to that report, which fully confirms the findings of an investigation that the channel carried out last year.
"I have not seen the CBI report and therefore I don't know what CBI has said in its report. I will give a befitting reply to CBI in SC," Subba had told CNN-IBN adding that he is an Indian citizen, and allegations that he faked his birth certificate are false.
But it's not what the CBI believes.
In its report to the SC, the CBI says there is evidence that Subba is guilty of forgery, cheating and giving false evidence about his birth certificate, confirming what CNN-IBN had reported last year.
The report says, "There is prima-facie commission of cognizable offences" by Subba.
CNN-IBN Special Investigation Team had revealed how Phanindranath Sarkar, who Subba claims is a witness to his birth, denied knowing Subba or his family.
CNN-IBN: Do you know any Moni Kumar Subba or Dhan Bahadur Subba?
Phanindranath Sarkar: No.
CNN-IBN: You don't know him.
Phanindranath Sarkar: No
Now the CBI has confirmed CNN-IBN's findings.
It says, "Phanindranath has denied knowing any person by name Mani Kumar Subba. The birth certificate was obtained by misrepresentation."
CNN-IBN investigation had revealed how Subba submitted different dates and places of birth to different authorities.
The CBI bears this out and says there are "inconsistencies and contradictions" in what Subba had said.
The report also confirms what CNN-IBN had said about how Subba had lied about his school records, and gotten a passport made using a fake birth certificate.
The Supreme Court has given Subba time till June 9 to respond to the CBI's report. But the Congress MP's time seems to be running out fast.
