New Delhi: After getting away with a light sentence there may be more trouble brewing for Allister Pereira. The Bombay High court took Sou Moto cognizance of the case and the possible miscarriage of justice.

Police investigations into the Allister Pereira case have once again come under the scanner. This time the Chief Justice of the Bombay High Court has taken Suo Moto cognizance of the case and demanded that the police and the state submit every piece of evidence, medical and forensic report to the High Court for the revision of the case.

First it was the session judge who slammed the sloppy investigation by the police and now the Suo Moto action and the observation by the High Court that there is a possibility of miscarriage of justice in the case.

Perhaps its about time that the police pulls up its socks and prepare answers for some very tough questions that are expected to come up in the High Court.

Questions like why did the police not submit any evidence of Alister's consumption of alcohol? Why were documents regarding extent of injuries not submitted in the court and how did the police submit pictures of the location, which did not match those taken the police photographer?

However after the High Court order the police are promising action.

Mumbai Commissioner of Police D N Jadhav said, “I assure that if there is any lapse on our part in the investigation proper action will be taken.”

The High Court has now set May 3 as the next date for the hearing and the police will have a tough time defending their actions in this case, which has now been thrown open once again.

Pereira, the son of a Mumbai businessman who was charged with running his car over seven people sleeping on a Mumbai pavement in suburban Bandra last year, was held guilty for causing death not amounting to culpable homicide.

The accident had killed seven pavement dwellers and seriously injured eight more. Pereira was driving the vehicle and was alleged to be under the influence of alcohol.

On April 13, Pereira was sentenced to six months imprisonment and fined Rs 500,000.
