Woman kills molestor, let off by court

New Delhi: Delhi High Court on Tuesday acquitted a woman, sentenced to life imprisonment for killing a man trying to rape her, on grounds that her acts in self-defence resulted in the murder.
A divison bench of Justice R S Sodhi and Justice P K Bhasin ordered acquittal of the women saying that she might have pushed Mastana, the victim, in self-defence that resulted in his death.
Mastana allegedly had tried to rape the woman three years back in central Delhi.
The accused had pushed the victim in self-defence while he had attempted to outrage her modesty, the bench observed while setting aside Additional Sessions Judge Rajneesh Kumar Gupta's verdict, which pronounced the woman Sept 21, 2006 guilty of murdering the man.
The woman, in her defence, had submitted that the deceased, who was under the influence of liquor, wanted to rape her. She had given a push resulting in his fall on a sharp-edged stone causing his death.
She alleged that the police had charged her for murder after she was taken to the police station.
According to the police, the woman was sleeping on a courtyard near a temple on Netaji Subash Marg in Daryaganj at 0415 hrs (IST) on April 4, 2004 and Mastana tried to rape her.
She was caught by police while fleeing from the sight of the incident.
The police had produced 18 witnesses before the trial court to prove the incident as murder.
